BC Government Gambling Website Brought Down by Privacy Breach
Apparently the Online Gambling site by the Province of British Columbia was not brought down by too much traffic after opening, as originally reported. The Globe and Mail now reports that the site was actually taken down because of a breach privacy that allowed players to see other player’s financial information and even use their funds for gambling.
“Someone could be playing away with [someone else's] money,” said BCLC president and CEO Michael Graydon.
A total of about $8,000 had to be redistributed once the errors were discovered and affected individuals tracked down, he said.
As well, bits of the personal data of 12 players were viewed by others, including some numbers on their credit cards, Mr. Graydon said.
“We reacted very quickly and in a transparent way to the customers involved, and we will make sure this does not happen again,” he vowed.
“We are one of the first jurisdictions in the world to do this. … It’s a new frontier, and technology is changing very rapidly.”
In an unrelated charge the Lottery Corporation also faces a $600,000 fine by the federal Financial Transactions and Reports Analysis Centre (FINTRAC), but is planning to appear.

Province of BC Overwhelmed by Success of Online Gambling Site
While the US state of Kentucky is fighting online gambling by seizing domain names, the Canadian Province of British Columbia has decided to try to get a part of the online gambling cake and was apparently overwhelmed by its success.
The British Columbia Lotter Corporation had launched its controversial online gambling site, PlayNow.com, last Thursday and was shut down by the initial spike of traffic.
“It’s been an overwhelming success with people in British Columbia to the point where we hit 100 per cent capacity in the first day,” Michael Graydon, president of the corporation, said Friday.
“So we decided to close the site down for a half a day, add some new hardware and servers to the system to be able to accommodate it. We’re in the process of doing that. Our IT people are working very hard to get it up and running.”
The site is still offline today. It will include casino games, bingo, sports, lotteries and other games and is expected to generate about $100 million in revenue.

.EE Matches the Amount of Registrations for Two Months in Two Days
Two days after the Estonian Registry operator, Eesti Internet, has gone live with their new registry system, they added another 1,329 new domains, effectively doubling the amount of registrations processed over the course of the preceeding two months. The new model of the registry for .EE domains is now based on selling domains through accredited registrars instead of direct sales through the registry. The changes went along with a broadening of conditions, allowing more people to register .EE domains:
- individuals are now able to register .ee domain names. For instance, they can use an e-mail address in the form firstname@lastname.ee;
- foreign nationals can now register .ee domain names. For instance, they can set up an Estonian-language e-service environment;
- one person can register more than one .ee domain name. For instance, if a company has several trademarks and wants to represent them all on the Internet under the .ee domain, they now can;
- registration of domain names will start taking place at two levels, meaning that the Estonian Internet Foundation has delegated the provision of service to registrants to registrars. The list of registrars is posted on the Estonian Internet Foundation website; and
- a regulatory fee has been established for domain names. The amount of the fee for registrants will be determined by registrars on the open market based on competition.
The transition to the new domain rules also applies to all .ee domains registered according to the old rules. These will be subject to a six-month transition period during which the domain registrants must choose a registrar and renew their domain registration with the registrar.
In parallel to the transition to the liberalised domain system, an independent body will be established within the Estonian Internet Foundation in order to resolve disputes related to domain names – the Domain Disputes Committee. The objective of the committee is to provide an expedited procedure as an alternative to judicial procedure so as to resolve any cases of misuse of domains where registration of a domain violates the rights of third parties, such as in the case of trademark infringement.

Survey For Registry Service Providers (new gTLDs)
In 2008 Jothan Frakes held an impromptu survey for registry service providers for new gTLDs at the ICANN meeting in Paris. The results were then consolidated into a matrix and published on the Names At Work blog by his friend Antony van Couvering – unfortunately DNN could not locate the information on the site today. Now, two years later and a bit further into the introduction process for new gTLDs- ICANN has published the 4th revision of the Applicant Guidebook for New gTLDs – Jothan Frakes has started a follow-up survey.
The first survey also seems to have had a big part in funding of the new gTLD service & consulting company Minds + Machines, which Frakes was part of. Now that he is not with the company any more, he can once again collect data in an independent survey of the registry services industry.

Minds + Machines Parents Posts Loss While Waiting for new gTLDs
The parent company of Minds + Machines, Top Level Domain Holdings [AIM: TLDH] reported their revenue for the period to the end of April with £32,000 ($49,000), with a loss of £462,000 ($708,000). The company is pretty much in a holding pattern until the release of the new gTLDs by ICANN and is expecting finalization of ICANN’s new gTLD Applicant Guidebook by November and is hoping for the opening of the first round at the ICANN Meeting in December. The company still has almost £4m in cash and equivalents and appears to have been bootstrapping operations. One of the former key-employees, Jothan Frakes, is not with the company any more. Potential threats to the company could be further delays of the release of new gTLDs through litigation.

According to the PDF published on the preview site, that also hosts a sign-up form for the beta of the software, The software is going to allow customers to sell domains, SSL certificates and Hosting.
DNN chatted with Jen Sale about the launch and the features of the new product via Instant Messaging. Read the full interview and learn more about the new product after the jump.
DNN: Thank you Jen for taking the time to talk to DNN today about this new product by the name of Yexa you are going to be launching at HostingCon. Can you tell us more about it?
Jen Sale: Thanks Frank! Of course. Approximately six months ago, we were on the hunt for an all-inclusive platform to manage a new retail registrar. We spent almost two months researching and testing a number of solutions but found them confusing, incomplete and expensive. Plus, there wasn’t just one solution that would do everything we required, or at the level of quality we expect for both ourselves and our customers. It was at this point we discussed creating our own solution, and many of the people we spoke to along the way expressed great interest in what we planned to develop.
For our initial product release, we have developed two software solutions – Yexa Registrar and Yexa Reseller. These two products are designed to work in conjunction with each other, and will address the gap we believe exists in the current marketplace. Yexa Registrar provides a fully functional white-labelled registry-registrar manager with a built-in reseller network. Yexa Reseller provides a cohesive, easy to set up and use, retail-facing domain and hosting solution.
DNN: So who are those two solutions mostly meant for existing registrars and resellers or new ones? It seems an interesting expansion of focus for you, considering you are launching it at a hosting conference.
Jen Sale: The two software solutions will cater to both existing and new registrars and resellers.
Yexa Registrar services individuals with ICANN and/or other ccTLD accreditation. This allows them to manage either their own personal domains directly (domainers), or operate a retail registrar with the option of creating their own reseller network.
Yexa Reseller services people wanting to run a retail-facing domain and hosting business, regardless of whether they’re an ICANN registrar or not. Existing resellers who wish to expand their customer offerings, and/or explore better provider offerings, can integrate Yexa Reseller which will support existing software via a comprehensive API.
One of the things we’ve been repeatedly asked for is an interface similar to Fabulous.com, and whether we’d be white-labelling it in the future. So this product is really a natural progression for us in offering domain services to our domain portfolio customers, and also extending into new business.
We’ve been on both sides of the fence, and have found the market distinctly lacking in suitable solutions, and we think we can do better.
DNN: Considering Fabulous.com’s background it seems that the software is mostly focused on selling domain names, yet the brochure also mentions SSL Certificates and hosting. Are you going to be offering a suite of different products?
Jen Sale: Yexa Registrar is targeted to domain operators (registrars). Yexa Reseller enables someone to create and manage a website which sells a number of web services, which may include domains, hosting, SSL certificates and more.
Yexa is fully flexible and provider neutral. It aims to provide a maximum level of choice to resellers, no longer tying them down to a single provider. Moreover, its modular structure will allow third parties to write custom extensions, in turn expanding choice even further and allowing resellers to provide innovative offerings to their end-users.
DNN: That sounds like a very smart and forward thinking platform design.
Yexa is described as a software in your material and on the site, but yet the description (at least for Yexa Reseller) sounds more like it is actually a hosted service for your clients. Can you share some more details on how a reseller or registrar sets Yexa up on their own server? What is handled on the customer’s side, what’s taken care of on your end?
Jen Sale: Yexa is a software application which is installed on the clients server platform of choice. The software has been designed to run on either Windows, Linux or OS X. The databases supported are MySQL, PostgreSQL and SQLite. Minimum supported PHP is 5.1.
In most cases the client’s customer IP belongs solely to them and is stored on their servers. Only in certain situations where we distribute information on their behalf (such as WHOIS data) does customer data need to be stored on our servers.
DNN: This sounds like a good solution to an age-old problem as to who owns the customer.
From what I understand you’re aiming at a very easy wordpress-like install of the software. So does this mean you don’t need to be too technical to use your solution, but yet one can also build on it if there is technical in-house knowledge (since there is an API)?
Jen Sale: Our primary goal was to create an easy-to-use solution which has the flexibility to cater for more sophisticated requirements, and to grow with the client’s business.
DNN: Can you tell us anything about the pricing structure yet, or is this too early to ask?
Jen Sale: Yexa Registrar pricing is a tiered cost-plus model. Whereas Yexa Reseller is a tiered monthly software license, plus cost per provider unit model.
Our pricing will be extremely competitive!
DNN: Yexa is an interesting name for the product – how was the name chosen? I can see from the whois history that it was apparently bought from a Canadian Domainer – is it an abbreviation or just a short name?
Jen Sale: We chose the name because it’s short and easy to remember. No, it doesn’t abbreviate to anything.
DNN: Judging from the whois the company is a separate entity – is it wholly owned by Dark Blue Sea or is it a division of Fabulous.com?
Jen Sale: Yexa is wholly owned by Fabulous.com’s parent company, Dark Blue Sea.
DNN: You took care of the DomainDistribution Network before and Yexa is your latest project – what was and is your involvement with this new product?
Jen Sale: I’ve been closely involved with the project since its inception, and have the dual role of Product Manager and Business Development Manager. I will also continue to manage the Domain Distribution Network and ROAR.

Have Your Say on Domain Transfers and Domain Hijacking
The following is a guest post by Michele Neylon, founder of the web hosting company Blacknight and chairman of the working group asking for feedback in this article. Since ICANN policy affects us all, we encourage our readers to provide their feedback on the issues identified by the working group.
ICANN’s Generic Names Supporting Organisation (GNSO) has formed a working group to consider changes to the domain transfer process to enhance security and reduce hijacking. The working group consists of registrars, aftermarket players, domainers and other members of the ICANN Community. The group published its preliminary recommendations at the ICANN meeting in Brussels two weeks ago and the 20-day comment period has just begun.
The key areas of focus for the working group are as follows:
- Whether a process for urgent return/resolution of a domain name should be developed, as discussed within the SSAC hijacking report (http://www.icann.org/announcements/hijacking-report-12jul05.pdf; see alsohttp://www.icann.org/correspondence/cole-to-tonkin-14mar05.htm);
- Whether additional provisions on undoing inappropriate transfers are needed, especially with regard to disputes between a Registrant and Admin Contact. The policy is clear that the Registrant can overrule the AC, but how this is implemented is currently at the discretion of the registrar;
- Whether special provisions are needed for a change of registrant near a change of registrar. The policy does not currently deal with change of registrant, which often figures in hijacking cases;
- Whether standards or best practices should be implemented regarding use of Registrar Lock status (e.g., when it may/may not, should/should not be applied);
- Whether, and if so, how best to clarify denial reason #7: A domain name was already in “lock status” provided that the Registrar provides a readily accessible and reasonable means for the Registered Name Holder to remove the lock status.

WIPO Panel Debates Definition of “Bad Faith” in UDRP Decision
In a recent decision in the dispute for the domain name Evoq.com, the WIPO panel let the original registrant keep the domain name. However the 3-person panel did not agree how exactly the “bad faith” criteria should be applied. The panel was not clear whether it mattered if a domain name was registered in bad faith when compared to the complainant’s trademark, or if this criteria could be applied against any existing trademark.
From the decision (emphasis added):
Faced with the fact that the Domain Name was registered in 2004, well before the Complainant was formed in 2007, the Complainant argues that the Domain Name was registered in bad faith directed at General Motors, which had announced a concept car called “Evoq” in 1999.
Some members of the Panel are inclined to conclude that, to prove bad faith registration, the Respondent must have had a bad faith intention with respect to the Complainant’s mark. However, the Panel does not need to reach a definitive conclusion on that issue because, even if bad faith directed at third parties could constitute bad faith for the purpose of this requirement, the Panel does not find the existence of any such bad faith on the evidence in this case.
So while the panel clearly thought that the domain owner did not register this domain in order to infringe on the complainant’s brand, at least one panelist thought it may have been infringing on another companies’ brand and thus could potentially constitute a bad faith registration.

The Complainant’s position is absurd. The Complainant argues that the Respondent should be found to have registered the domain name in bad faith, even though the Complainant wasn’t even in existence at the time the domain name was registered, because the disputed domain name was registered after an unrelated third party; General Motors, acquired trademark rights. The fact that the Complainant was able to adopt EVOQ as a trade name and trademark for its communications and branding business years after General Motors acquired trademark rights, in ostensible “good faith”, means that the Respondent was equally able to register the domain name in good faith notwithstanding General Motor’s limited rights. What is good for the goose is good for the gander. EVOQ is a name that could lend itself to any number of business endeavours. This is a case of attempted domain name hijacking in my opinion, pure and simple.

US Authorities Seize Domain Names of Download Sites

This Messages Appears on the Seized Domains
US Authorities announced today in a press conference held at Disney Studios in Burbank that their new initiative “Operation in Our Sites” seized nine domain names linked to websites that could be used to download pirated content. The initiative partners law-enforcement officials with representatives of the entertainment industry.
“American business is under attack from counterfeiters and pirates,” Immigration and Customs’ Assistant Secretary John Morton said at the press conference. “Internet crooks threaten the U.S. economy on a grand scale.”
Officials said that the seized sites had attracted 6.7 million visitors in a single month.The seized domain names and their registrars were:

Sex.com for Sale via Sedo
The sex.com saga continues. Escom, LLC the holding company that owns the domain name went into foreclosure earlier this year. An auction for the domain name had been scheduled for March, but was stopped last-minute. As reported before on DNW, Sedo now confirmed that they are going to be the broker for the sale of the Sex.com domain name. VideoDating.com, now owned by someone who lives near Toronto, looks like a website preview at this point in time, not yet featuring any real functionality on the site, but static pages. The domain was owned by Steve Newman before, who was the president of Greatdomains.com (owned by Sedo since 2007).

.XXX TLD To Be Approved Tomorrow?
According to Kieren McCarthy ICANN’s general counsel read a statement at the start of the public forum at the current ICANN meeting in Brussel, stating that the Board had accepted the results of the independent review panel and thus would approve the .xxx TLD tomorrow. The board had delayed the decision until the 38th ICANN meeting in order to gather additional comments from the public.
The board would then enter the contract negotiations with application ICM Registry and then refer the contract to the Governmental Advisory Committee since they had raised concerns in the past.
This decision would ignore the lobbying of the adult industry against the new extension, however the registry might have some challenges selling domains under the new TLD.

Trellian Launches Direct Navigation Ad Network
The Australian based company Trellian has just sent an email to its registered users announcing the launch of the “Trellian AdNetwork“, which allows the purchase of direct
navigation domain traffic. The traffic originates from the domains parked on the Above.com Domain Parking Manager. According to the note the network reaches over 200 million unique visitors a month via over 1.2 million domains and redirects users to the domains to the advertisers in the network. The bid prices in the network are on a per unique visitor basis.
Advertisers will place a bid based on keywords or a list of categories and define their daily budget. The top bidder for the keyword receives the majority of the traffic, Bidders 2-5 will receive a percentage of the available traffic. Any bidder ranked sixth or lower will not receive any traffic. During the open beta only a small percentage of the available traffic will be made available to bid on. Any of the traffic will only be sent to the advertisers if they pay a higher price than the domains earns from the other parking providers.
